Sales and Delivery Conditions for Mimo Firouzan

The following terms and conditions apply to all deliveries and transactions with Mimo Firouzan (hereafter referred to as "Mimo"). These terms govern all agreements between Mimo and the customer unless otherwise agreed in writing. Customers are required to comply with these terms at all times.

1. Disclaimer

Mimo reserves the right to adjust product prices, correct inadvertent errors, and make changes to these terms without prior notice. Please note that colors displayed in product images may vary slightly due to differences in screen displays and lighting. Mimo is not responsible for delays caused by shipping carriers, customs, or other third parties.

2. Payment Terms

2.1 Payment Methods
All prices include VAT unless stated otherwise. Payments can be made via major credit cards, Apple Pay, and other payment methods as specified at checkout.

2.2 Payment Timing
For all products, the full amount is charged upon order confirmation.

3. Delivery

3.1 Production and Shipping
Mimo’s bespoke products are handcrafted to order, requiring a production time of approximately 2 weeks. After production, depending on the chosen delivery method, the item will be shipped using the chosen courier service, or will be made ready for pickup at the Mimo Firouzan Store. Delivery time depends on the courier and is not guaranteed by Mimo. International orders may incur additional customs or tax charges, which are the responsibility of the customer.

3.2 Delivery Charges
Shipping charges are calculated based on delivery destination and are added during the checkout process. These charges are separate from the product price and are the responsibility of the customer, unless otherwise specified.

3.3 Product Storage
If items are not picked up within 6 months of the completion date, Mimo reserves the right to charge a storage fee of 5% of the item's value per additional month. Customers will be notified before any storage fees are applied.

4. Returns and Right of Withdrawal

4.1 Made-to-Order Items
As all Mimo’s products are made-to-order, they cannot be returned unless defective or deviating from agreed specifications. If defects are identified, customers must notify Mimo within a reasonable time frame (within 2 years from purchase) to arrange for a remedy, such as repair, replacement, or refund.

4.2 Non-Made-to-Order Items
For non-made-to-order items (e.g., accessories, shoes, belts, etc.), the customer has 14 days from receipt to withdraw from the purchase, provided the product is unused, undamaged, and in its original packaging. If a customer wishes to return a non-made-to-order item, they must notify Mimo within this 14-day period.

4.3 Right of Withdrawal Exceptions
Under EU Consumer Rights Directive, custom-made or bespoke items are exempt from the 14-day right of withdrawal unless they are defective or not as described. This exception applies to all made-to-order products purchased from Mimo.

4.4 Exchange for Incorrect Size
If the size of a product does not fit, Mimo offers an exchange, provided the product is in unused and undamaged condition and returned in its original packaging. The buyer is responsible for all shipping costs associated with the exchange.

5. Intellectual Property and Brand Protection

All designs, trademarks, and content provided by Mimo are the exclusive property of Mimo Firouzan and are protected under copyright and intellectual property laws. Customers may not use, replicate, or distribute Mimo’s content, designs, or branding for commercial purposes without prior written consent. Breaches of intellectual property rights will result in legal action to protect the Mimo Firouzan brand.

6. Complaints and Remedies

6.1 Complaint Period
Customers have a 2-year complaint period for issues arising from manufacturing defects under the Danish Sale of Goods Act. Customers must notify Mimo promptly to resolve the issue. If a product is defective, Mimo will offer the customer the option for repair, replacement, or refund, depending on the nature of the defect.

7. Limitation of Liability

Mimo is not liable for indirect or consequential losses such as loss of profit, goodwill, or data.

8. Force Majeure

Mimo is not liable for delays or damages caused by circumstances beyond its reasonable control, including but not limited to labor disputes, natural disasters, pandemics, transportation disruptions, or government actions. In such cases, Mimo will notify customers of any significant delays.

9. Governing Law and Dispute Resolution

These terms are governed by Danish law. Any disputes will be resolved in accordance with the applicable jurisdiction provisions in Denmark. The customer has the right to bring complaints before the Danish Consumer Ombudsman if they are unsatisfied with the outcome.

10. Personal Data

Mimo Firouzan processes customer data in accordance with the General Data Protection Regulation (GDPR). Personal data is used exclusively for order processing and will not be shared with third parties without customer consent. 11. Changes to Terms and Conditions

Mimo reserves the right to update and amend these terms without prior notice. Continued use of Mimo’s services constitutes acceptance of these terms. Customers are advised to check the terms regularly for any changes.
